WATER APPORTIONMENT PLAN

Prohibition against water waste: No shareholder is entitled to waste water under any circumstances. The Company may discontinue service to any shareholder or shareholder’s land where negligent or wasteful use of water is determined to exist.
In the event of drought conditions or a limited water supply Pinon Pines Mutual Water Company will implement the following restrictions dependent upon the severity of the situation:

Level 1: Conservation Necessary (elimination of non-essential or unauthorized uses):
These conservation measures are voluntary and may be immediately implemented as described in article XVIII of the company’s bylaws.
A. Use of potable water for washing vehicles, boats, buildings, construction cleanup, dust control, or similar uses without a hose fitted with an automatic shutoff nozzle or similar device is prohibited. However, use of a bucket for vehicle and boat washing is permitted subject to non-wasteful applications.
B. Use of potable water to clean buildings, decks or privately owned paved surfaces without a hose fitted with an automatic shutoff nozzle or similar device is prohibited.
C. Use of potable water to clean community streets, parking lots and similar community uses is prohibited except to protect the public health and safety as determined by Pinon Pines Mutual Water Company. When approved by the water company, such uses may be accomplished solely by Pinon Pines Estates Home Owners Association or its contractor and shall be coordinated in advance with Pinon Pines Mutual Water Company.
D. Use of potable water which results in flooding or runoff in gutters, waterways, patios, driveways, or streets is prohibited.
E. Outdoor Irrigation:
i. Outdoor irrigation will be prohibited between the hours of 10:00 a.m. and 6:00 p.m.
ii. Irrigation of private and public landscaping, turf areas and gardens will be permitted at even-numbered addresses only on Mondays, Wednesdays, and Sundays and odd-numbered addresses on Tuesdays Thursdays, and Saturdays.
iii. All shareholders are directed to use no more water than necessary to maintain landscaping.
F. Allowing a leak to continue more than 5 days after the water company has notified the responsible party in writing is prohibited.

Level 2: No Outdoor Irrigation:
In the event voluntary conservation measures (Level 1) are insufficient to control a threatened, or actual, water shortage these mandatory conservation measures will be imposed. A public meeting will be held to discuss these conservation measures unless a situation such as a power outage or a failed pump requires immediate implementation of this plan.
A. Use of potable water for washing vehicles, boats, buildings, construction cleanup, dust control or similar uses is prohibited, including use of a bucket for vehicle and boat washing.
B. Use of potable water to clean buildings, decks, or privately owned paved surfaces is prohibited.
C. Use of potable water to clean community streets, parking lots and similar community uses is prohibited except to protect the public health and safety as determined by Pinon Pines Mutual Water Company. When approved by the water company, such uses may be accomplished solely by Pinon Pines Estates Home Owners Association or its contractor and shall be coordinated in advance with Pinon Pines Mutual Water Company.
D. Use of potable water which results in flooding or runoff in gutters, waterways, patios, driveways, or streets is prohibited.
E. Outdoor Irrigation:
i. Outdoor irrigation will be prohibited at all times to maintain system pressure during this critical situation. Pinon Pines Mutual Water Company will revoke this restriction as soon as it is safe to do so.
F. Allowing a leak to continue more than 5 days after the water company has notified the responsible party in writing is prohibited.
G. Use of potable water for decorative fountains or the filling or topping of decorative lakes or ponds is prohibited, except those using recycled water.
H. Use of potable water for the filling or refilling of swimming pools and spas is prohibited, except to prevent structural damage and/or to provide for the public health and safety as determined by Pinon Pines Mutual Water Company and shall be coordinated in advance with Pinon Pines Mutual Water Company.

Level 3: Critical Water Use Only:
In the event Level 1 and Level 2 conservation measures are insufficient to control a threatened, or actual, water shortage these mandatory conservation measures will be imposed. A public meeting will be held to discuss these conservation measures unless a situation such as a power outage or a failed pump requires immediate implementation of this plan.
A. Any use of water not necessary for personal hygiene, health, and cooking is prohibited.
B. Use of potable water for washing vehicles, boats, buildings, construction cleanup, dust control, or similar uses is prohibited, including use of a bucket for vehicle and boat washing.
C. Use of potable water to clean buildings, decks, or privately owned paved surfaces is prohibited.
D. Use of potable water to clean community streets, parking lots, and similar community uses is prohibited except to protect the public health and safety as determined by Pinon Pines Mutual Water Company. When approved by the water company, such uses may be accomplished solely by Pinon Pines Estates Home Owners Association or its contractor and shall be coordinated in advance with Pinon Pines Mutual Water Company.

Procedures and Penalties:
An infraction of PPMWC’s conservation measures will initiate a twelve month period during which noncompliant situations may result in the following progression of events and penalties. In addition to the penalties listed below Pinon Pines Mutual Water Company reserves the right to shut off the water supply to premises to prevent loss of water and shall be held harmless for damage to appliances and premises due to such action. In the event that a complaint is received by water company personnel all reasonable means will be taken to verify the accuracy of the violation before a warning or assesment is issued.
i. First Occurrence: Shareholder or occupant notified of noncompliant situation by in person contact if possible. Courtesy Notice handed to shareholder/occupant by service person if possible, hung on door if not. Letter mailed to shareholder at known address or phone call explaining noncompliance, present water supply conditions, conservation measures in effect, and penalties for noncompliance.
   ii. Second Occurrence: Shareholder or occupant again notified of noncompliant situation by personal contact if possible. Water Waste door hanger handed to shareholder/occupant by service person if possible, hung on door if not. Letter mailed to shareholder at last known address or phone call explaining noncompliance, referencing first letter, and assessment of twenty-five dollar ($25.00) excess use penalty and/or installation of a flow-restricting device on the property’s service line.
   iii. Third Occurrence: Shareholder or occupant notified of noncompliant situation by personal contact if possible. Water Waste door hanger handed to shareholder/occupant by service person if possible, hung on door if not. Letter mailed to shareholder at last known address or phone call explaining noncompliance, noncompliance history, first and second letters, and assessment of one hundred dollar ($100.00) excess use penalty for noncompliance and/or installation of a flow-restricting device on the property’s service line.
iv. Fourth Occurrence: Shareholder or occupant notified of noncompliant situation by personal contact if possible. Waste Water door hanger handed to shareholder/occupant by service person if possible, hung on door if not. Letter mailed to shareholder at last known address or phone call explaining noncompliance, noncompliance history, first through third letters, and assessment of an additional two hundred dollar ($200.00) excess use penalty for noncompliance and/or installation of a flow-restricting device on the property’s service line.
v. Fifth Occurrence: Shareholder or occupant notified by personal contact if possible. Water Waste door hanger handed to shareholder/occupant by service person if possible, hung on door if not. Letter mailed to shareholder at last known address or phone call explaining noncompliance, noncompliance history, first through fourth letters, assessment of an additional penalty of five hundred dollars ($500.00) excess use penalty for noncompliance and/or installation of a flow-restricting device on the property’s service line.
